We reserve the right to modify the Terms of Use without notice and at any time. Remember to consult this page regularly to see changes to the Terms of Use. The version published on the Site at the relevant time applies between you and us. In the Terms of Use, the terms "Swissgames", "us", "our" and "our" refer to Swissgames Sàrl, a Swiss company registered in the business register of the Canton of Geneva. "You", "your" and "your" refer to any person using or accessing the Site.
Special conditions: any special conditions mentioned on the Site in connection with a particular product(s).
Order Confirmation: the order confirmation which is sent by e-mail to the Customer and/or which is available via his account.
Client: anyone ordering via the Site.
Calendar days: the days of the week, including weekends and public holidays officially recognised by the cantonal legislation applicable to Swissgames (i.e. Geneva).
Working days: the days of the week, excluding weekends and public holidays officially recognised by the cantonal legislation applicable to Swissgames (i.e. Geneva).
Customer Service: Swissgames customer service.
The other terms beginning with capitals have the meaning assigned to them in the Conditions of use.
The GTCs govern the contractual relationship – and form an integral part of the contract – between Swissgames, on the one hand, and the Customer, on the other. They are an integral part of the Terms of Use that apply to the surplus. In the event of differences between the GTCs and the Terms of Use, the first will prevail.
By placing an order via the Site, the Customer acknowledges that he has read, understood and accepted, without any reservation, the Terms and Conditions. In case of disagreement with the Terms and Conditions, the Customer shall refrain from placing an order via the Site.
Swissgames reserves the right to modify the GTCs at any time without notice by publishing a new version of the GTCs on the Site (which cancels and replaces the existing version). Any order placed after the publication by Swissgames of a new version of the GTC shall be accepted for this new version.
The Special Conditions are an integral part of the General Terms and Conditions that apply to the surplus. In case of divergence between Special Conditions and General Terms and Conditions, Special Conditions will prevail.

These Terms are specific to our site and protected by copyright. The reproduction, dissemination or other use of these Terms is prohibited, unless we obtain our prior written consent. Any prohibited use of these Terms will be continued.
Although Swissgames strives to inform its Customers as fully and faithfully as possible, the photos, videos and texts illustrating and describing the products (the technical dimensions and specificities of the products, etc., as well as the status of the stocks mentioned on the Site are non-contractual and are provided for information purposes only. They are in no way an offer from Swissgames (which does not guarantee the accuracy) and cannot be described as guarantees or promised qualities.
The Customer is solely responsible for the accuracy and completeness of the data that he or she provides when registering on the Site. If necessary, the Customer will communicate to Swissgames any changes to the data he has provided.
The Customer must indicate a valid e-mail address on which all communications relating to the order will be sent. It is up to the Customer to keep this address in effect and to read the emails sent by Swissgames. The Customer will also make sure to configure – and check regularly – its "desirable mail" box to ensure that no Swissgames email is included. Any communication made to the Customer by e-mail shall be deemed to be received by the Customer at the effective date and time of receipt, but not later than 24 hours after its dispatch by Swissgames.
The Customer chooses, when registering a password allowing him to place an order or to use other functions of the Site. This password is strictly confidential. Under no circumstances should it be disclosed to third parties. The Customer is solely responsible for the use, retention and security of his password which he can modify at any time via the Site. He is responsible for any order placed, even without his knowledge, using his password. If the Customer knows or suspects that a third party has access to his password, he must notify us immediately
Only Customers who are major, able to discern and are not under curate can place an order via the Site.
To place an order, the Customer must follow the procedure available on the Site. Any other order procedure is excluded.
By placing an order, the Customer binds and declares to formulate against Swissgames a firm and definitive offer to buy the goods selected, this under the conditions indicated on the Site. The validity of the offer may be subject to maximum or minimum quantities. Formally, the Customer deposits his offer at the time his payment is approved. The sale is accepted – and therefore the contract is concluded (under the resolutory conditions provided for in articles 9 to 11) – that from the moment Swissgames sends the Order Confirmation to the Customer. Swissgames reserves the right to refuse an offer at its discretion, without being required to state the reasons for it.
The data recorded by Swissgames is irrefutable proof of the orders. The data recorded by the payment system constitute irrefutable proof of financial transactions.
Swissgames reserves the right to change its prices at any time. Only the price indicated in the Order Confirmation is valid.
The prices indicated on the Site are expressed in Swiss francs (CHF) and include VAT, if applicable. They do not include any additional fees that may be required by the applicable legislation. Preparation and delivery costs are included. Prices shown on the Site are valid only in Switzerland
The methods of payment accepted by Swissgames are exclusively those indicated on the Site.
Any order is subject to prior payment the full amount of the order, as well as preparation and delivery costs.
Payments are made through the servers made available and secured by Swissgames' partner financial institutes, so that no financial information about the Customer passes through our servers.
The risk of a malfunction of the payment system is borne by the Customer, at the complete discharge of Swissgames.
The preparation and delivery costs are those mentioned in the Order Confirmation.
Unless otherwise noted, the products are shipped to the delivery address indicated by the Customer at the time of the order. The Customer is solely responsible for the accuracy and timeliness of the address that he tells Swissgames. We cannot therefore be held responsible for the absence of delivery of a product in the event of an indication of an erroneous or incurrent address.
If a parcel is returned to us by the carrier after a unsuccessful delivery (exceeded postal delays, erroneous consignee address, etc.), the Customer is notified by means of an e-mail sent to the address he has indicated in his profile or when ordering. Without news from the Customer within 3 months of sending the said e-mail, the order is cancelled. Swissgames is then relieved of its obligation to deliver the goods and the amount paid by the Customer is retained by Swissgames as a conventional penaltyThis is the balance of all accounts and claims in connection with the order concerned.
The transport costs and risks inherent in the return of an unclaimed package (including in the event that the carrier does not deposit by notice of transit) and/or possible re-shipment are borne by the Customer exclusively, as are the risks inherent in the storage of the returned goods. Prior to re-shipment, Swissgames may request the Customer to pay the related costs.
Swissgames makes its best efforts to have the ordered products shipped within 5 working days, starting from the end of the sale. This period – as well as the delivery guarantees mentioned in the Special Conditions – is of a purely indicative and non-contractual nature.
The Customer may revoke his order at the following (cumulative) conditions:
The Customer addresses his request to Customer Service by email to info@ugearsmodels.ch. The request must reach Swissgames in the 10 Calendar days following delivery of the goods.
The goods must not have been used or even unpacked. It must remain in a completely new condition, suitable for resale.
The goods must be returned to Swissgames, at the exclusive expense of the Customer, in its original packaging, accompanied by its complete documentation and any accessories. The procedure in Article 14 shall apply.
The Customer's request must not concern the following articles where the right of revocation is excluded(i) products for which it is expressly stated in the Special Conditions that no return is possible.
In case of delay in delivery, the Customer may revoke his order at the following (cumulative) conditions:
- Swissgames did not ship the ordered goods (delivery date to the carrier being authentic) within 10 working days from the date of dispatch of the Order Confirmation.
- The Customer addressed his request to the Customer Service by email to info@ugearsmodels.ch
- The Customer's request reaches Customer Service at least 24 hours before the ordered product has been delivered to the carrier for delivery.
After the conclusion of the contract, Swissgames is entitled to cancel an order, not yet delivered, at any time and without having to state the reasons for it to the Customer.
In the event of revocation in accordance with Articles 9, 10 or 11, the advance paid by the Customer (excluding preparation and delivery costs) shall be refunded by bank transfer to the account used for the initial payment of the order. Reimbursement shall be made for the balance of all accounts and claims. In no case will the Customer be able to claim additional damages from Swissgames, its claims being limited exclusively to the full refund of the advance paid (excluding preparation and delivery costs and interest free). If this appears in the Special Conditions and subject to availability, some products may also be exchanged. In the event of revocation due to delay in delivery (Article 10) or exercise of the right to revoke Swissgames (Article 11), Swissgames is relieved of its obligation to deliver the goods.
Upon receipt of the order, the Customer must immediately inspect the goods delivered.
If necessary, before signing the carrier's delivery note, the Customer must verify whether there are apparent defects at the time of delivery (product delivered which does not correspond to the product ordered, incomplete product, etc.). In case of apparent defects, the Customer (or any other person receiving the goods for him) must indicate it on the delivery note, in the form of a handwritten reservation accompanied by his signature. In the absence of such a reservation, such defects will be considered accepted.
In the case of defects which are not apparent at the time of delivery against signature or in the absence of such a method of delivery, the Customer shall notify the Customer Service of any defects within 3 working days from the moment of knowledge of the defect, otherwise the defect will be considered accepted. With regard to return, the Article 14 procedure applies.
The goods ordered on the Site are guaranteed by its manufacturer, in accordance with the specific terms and conditions set out in the original documentation delivered with the goods or available from the manufacturer. It is up to the Customer to inform the details of the warranty directly with the manufacturer. To remove any doubt in this regard, it is specified that only the manufacturer is liable for the guarantee, excluding Swissgames. Under no circumstances does Swissgames guarantee the guarantee offered by the manufacturer.
ALSO TO THE MANUFACTURER'S GUARANTEE, SWISSGAMES DOES NOT OFFER ANY GUARANTEE, WHAT IT IS. ARTICLE 199 CO (FRAUDULATED DISSIMULATION OF A DEFAUT) IS RESERVED. SWISSGAMES NIEST, EXCEPT EXCEPTION, NOT THE MANUFACTURER OR REPAIRER OF PROPOSED PRODUCTS ON THE SITE.
When purchasing a variety of products, the possible defective character of a product, its replacement or the inability to ship does not invalidate the entire purchase contract. Swissgames manages the order of each product independently.
In the event of a general request for revocation (Article 9) or default (Article 13), the Customer must obtain a return authorization from the Customer Service prior to any return of goods. No goods will be accepted unless the return has previously been accepted by Swissgames.
Upon receipt of the return authorization, the Customer shall have 7 Working days to return the goods to Swissgames. After this deadline, the return will be refused. The return must be by means of the original packaging, against signature. The Customer alone bears the risks associated with the return of the goods. Except in the case of return justified because of default (Article 14), the costs of return shall be borne by the Customer.
